Subject:    Consider Ordinances 2211 and 2212 and Resolutions Setting 2019 Fees and Charges

INTRODUCTION
On October 16, 2018, the attached ordinances adjusting certain fees and building inspection fees were introduced and are now being presented for adoption along with resolutions which include fees not set by ordinance.  Rates for the civic center, ice arena, golf course and utility funds are set by separate City Council action throughout the year.
DISCUSSION

City staff conducted a fee study in 2018 to determine if current user fees were set at a reasonable level.  A fee study is completed approximately every ten years.  The City's 2018 fees were compared to other metro cities of similar size.  The finance department compiled the data and held meetings with staff to review each fee.  The results of the study revealed that certain fees were slightly higher than average while others were lower or comparable.  The proposed 2019 fees are based on these results.  If staff determined that a fee should be increased in 2019, that fee has been increased by the 2018 annual adjustment of 2.75%.  A request for a rate change is made only if the adjustment is enough for the fee to be rounded to the next significant dollar amount.  

(1) Ordinance Adjusting Certain License Fees, Service Fees, and Related Charges

Certain fees under Section 5-209 (alcoholic beverages) and the gambling investigation fee under Section 5-2008 of the City Code are set by Minnesota Statutes and did not change for 2019. 
 
Since there were no proposed increases to fees for the sale of alcoholic beverages, no public hearing was required. 

The tavern license fee has been decreased from $640 to $300 based on the fee study comparison to other metro cities.

The only proposed increases to fees for 2019 are noted in Section 4 (fees established for the permits and approvals in Title 11 of the revised City code). 

(2) Ordinance Establishing Permit and Inspection Fees for the Building Inspections Division

There are no proposed changes to the permit and inspection fees for 2019.

(3) Resolution 18-108 Establishing Certain Fees and Charges

Certain fees are set by Minnesota Statutes and did not change for 2019.  These include the returned check charge, day care inspection fee, and document charges.  The State did not change these fees for 2019.

The City purchases water meters with couplings or flange kits and sells them to contractors for installation in new construction.  The rate consists of our cost and a markup of 33% to cover handling and future replacements since there is no charge for the replacement of water meters.  The City received the 2019 price quotes from the water meter vendor and all meter prices will be increasing as presented in Resolution 18-108.

For those fees that have proposed increases, the 2018 fee is included in parentheses in front of the 2019 proposed fee as presented in Resolution 18-108.

There is one new fee proposed for 2019.  A fee of $75 was added for a rental inspection cancellation fee.  This fee would apply only to appointments that are cancelled less than 24 hours in advance. 

(4) Resolution 18-109 Establishing Certain Fees and Charges for CTN Studios

The CTN Studios fee schedule includes three new proposed fees for 2019:

1.  Atomos Shogun Flame 4K HDMI/SDI recorder....$45 per day
2.  Fuji XA88x8.8BESM box lens with Vinten 70 head and tripod....$1,500 per day
3.  Fuji HA42x9.7BERD long ENG lens (2 available)....$600 per day

There are no proposed increase to the 2018 existing CTN Studio fees for 2019.

 

RECOMMENDATION
(1)  Adopt Ordinance 2212 Revising Certain License Fees, Service Fees and Related Charges effective January 1, 2019.

(2)  Adopt Ordinance 2211 Establishing Permit and Inspection Fees for the Building Inspections Division as Authorized by Minnesota Statutes Section 16B.62, subdivision 1 effective January 1, 2019.

(3) Adopt Resolution 18-108 Establishing Certain Fees and Charges effective January 1, 2019.

(4)  Adopt Resolution 18-109 Establishing Certain Fees and Charges for Use of CTN Studio Facilities effective January 1, 2019.
