Subject:    Accept Right of Entry Agreement with SAG Coon Rapids Development

INTRODUCTION
Staff is requesting Council accept the attached right of entry agreement with SAG Coon Rapids Development for a new Honda dealership location in the Gateway Commerce Center 5th Addition.
DISCUSSION
SAG Coon Rapids Development received site plan and final plat approval during the fall of 2017 for the construction of a new Honda dealership facility, which is to be located on the northwest and southeast sides of Gateway Drive just north of highway 10.  There's a significant amount of private watermain pipe to be constructed within this proposed development, which is to be maintained by private forces.  The right of entry agreement allows the City to periodically enter the property to exercise hydrants, valves, and to flush the system.  As previously stated, the utility system within the site is considered private, and the property owner will continue to own and maintain it; this right of entry agreement simply provides the City the ability to ensure appropriate fire protection.
RECOMMENDATION
Staff recommends Council accept the attached right of entry agreement with SAG Coon Rapids Development for their new Sutton Honda dealership location in Gateway Commerce Center 5th Addition.

BUDGET IMPACT:
The right of entry agreement is being dedicated to the City at no cost. Exercising of valves and flushing of the hydrants will occur with other similar activities as planned and scheduled by Public Works staff.
