Accept Right of Entry and Operations & Maintenance Agreements with RLB Northwest, LLC

Staff is requesting Council accept the attached right of entry and operations & maintenance agreements with RLB Northwest, LLC for a new Raising Cane's restaurant.
RLB Northwest, LLC received site plan approval in January, 2018 for the construction of a new fast food restaurant, Raising Cane's, which is to be located at 13001 Round Lake Boulevard. The right of entry agreement allows the City to periodically enter the property to exercise hydrants, valves, and to flush the watermain system. The utility system within the site is considered private, and the property owner will continue to own and maintain it; this right of entry agreement simply provides the City the ability to ensure appropriate fire protection.
Per the City's Comprehensive Storm Water Management Plan, the owner is required to provide storm water treatment practices (STPs) to accommodate stormwater quality and rate of flow of area runoff. STPs on the property include an infiltration basin and sump manhole. The operations & maintenance agreement outlines RLB Northwest's maintenance responsibilities, and the City's requirements related to inspections and reporting methods. The agreement also allows the City to periodically enter the property to inspect all aspects of the STPs and related drainage as necessary.
Staff recommends Council accept the attached right of entry and operations & maintenance agreements with RLB Northwest, LLC for their new Raising Cane's location at 13001 Round Lake Boulevard.
The right of entry and operations & maintenance agreements are being dedicated to the City at no cost. Exercising of valves and flushing of the hydrants will occur with other similar activities as planned and scheduled by Public Works staff.
