Accept First Amendment to Easement Agreement from James M. Stanton Trust

Council is asked to accept the First Amendment to Easement Agreement from James M. Stanton Trust for sidewalk and snow storage purposes.
In 2012, City Council accepted an easement agreement from the Jim M. Stanton Trust U/A February 24, 2010 for sidewalk and snow storage purposes along 3200 Main Street NW (Wells Fargo building). The Trust is now in the process of selling the property to a new buyer. The title company has raised an issue with the easement and is requesting that the easement agreement be amended to account for bench(es) and streetscapes located within the easement. While both the City and the Trust believe the current easement agreement adequately accounts for the bench(es) and streetscapes in the spirit of cooperation, both are willing to amend the easement agreement to alleviate any concerns for the new buyer and the title company.
The First Amendment to the Easement Agreement has been prepared and specifically provides for the placement of benches, brick seating, and streetscapes within the easement area. Staff do not believe that the Amendment limits current and or future use of the sidewalk.
