Hold Public Hearing and Consider Adoption of Resolution 17- 82 Rescinding Final Plat Approval for Gateway Commerce Center 5th Add. Planning Case 16-12

Pursuant to Title 11, Section 11-1504.2(3), the City Council is being asked to approve Resolution 17-82 rescinding the final plat approval for Gateway Commerce Center 5th addition.The final plat has not been recorded with Anoka County within the required time frame.
At the May 17, 2016 meeting, Council approved the final plat for Gateway Commerce Center 5th Addition. The plat was approved to create a lot for a proposed hotel. The plat was approved but the applicant withdrew their application for the hotel and the plat was never recorded. On July 5, 2017 Council approved a revised version of Gateway Commerce Center 5th Addition in conjunction with a PUD amendment to allow a second new car dealership.
On July 12th and July 17th staff discussed with the applicant the process for rescinding the final plat for the original version of the Gateway Commerce Center 5th Addition. A follow-up e-mail was sent on July 18th. Once the final plat approval is rescinded, the applicant can proceed with the recording process for the recently approved plat.
City Code Title 11, Section 11-1504.2(3) requires that, "Within 90 days after the City Council takes final action on a subdivision plat, the owner must record the plat with the County. Failure of the subdivider to comply with the requirements of recording will be cause for rescission of approval by the City Council."
Pursuant to Title 11, Section 11-1504.2(3) staff requests that the City Council take formal action to rescind their final plat approval for Gateway Commerce Center 5th Addition.
In Planning Case 16-12, staff recommends the City Council:
Conduct a public hearing.
Approve Resolution 17- 82 rescinding final plat approval for Gateway Commerce Center 5th Addition.
