Vacation of Public Roadway Easement, Golf View Estates

On July 5, 2017, Council adopted Resolution 17-72 ordering a public hearing to consider the vacation of a public roadway easement that serves as access to 555 127th Avenue NW.
This vacation is being considered in conjunction with a proposed driveway agreement with a resident as part of City reconstruction project 17-4. This roadway easement is contained within platted Anoka County right-of-way (County Roadway A), and is the only access point for the property located at 555 127th Avenue NW. No other properties have driveways that access said public roadway easement or right-of-way; all adjacent properties are addressed and accessed from 127th Lane NW. The City and property owner (along with the County) are agreeable, to reconstructing a new driveway onto County Parkway A. The property owner would not agree to the driveway going out to 127th Lane NW. The proposed agreement is contingent upon successful vacation of this roadway easement.
City staff believes the vacation to be in the best interest of the residents of Coon Rapids as the City will no longer need to maintain a public roadway for the benefit of one property. On July 5, 2017, Council adopted Resolution Number 17-72 to consider vacation of a public roadway easement. The process for vacating an easement under the City's charter requires a public hearing and passage of a resolution. All utilities have been notified and all have no objection to the vacation.
Council is asked to conduct a public hearing and adopt Resolution Number 17-87 vacating a public roadway easement. Vacations commenced on the initiative of the City require a four-fifths majority vote in favor of the resolution to vacate.
