Case 17-17V, Special Assessment Objection, Series Coon Rapids of Athans Holdings, 430 Coon Rapids Blvd NW, 25-31-24-34-0046
Unpaid penalties in the amount of $866.00 associated with code enforcement activity against the subject property are proposed to be assessed to the property. This amount was published in error as a result of a clerical error and staff is proposing the assessment be reduced to $733.00, which includes the administrative citation penalty plus the abatement costs and associated abatement administrative fee. The property owner has filed an objection to the assessment.
BACKGROUND & CONSIDERATIONS
The following chronology relates to actions and procedures leading to the special assessment in this matter.
On 11/04/2017, Administrative Citation #66611-27238 was issued with one count for exterior storage in a commercial district ($300.00 penalty) and one count for an inoperable/unlicensed vehicle ($300.00 penalty). The citation established a compliance date of 11/14/2017. The citation was mailed to the owner of record for this vacant property and was not returned as undeliverable.
On 11/17/2017, the property was re-inspected and found in compliance with the inoperable/unlicensed vehicle. The exterior storage in a commercial district was not in compliance. The items in violation at the property were abated and the $300.00 penalty for exterior storage in a commercial district was applied.
Penalties charged: $300.00 administrative penalty plus abatement costs of $359.00 and a $74.00 abatement administrative fee.
Total penalties and costs charged: $733.00
In case 17-17V, it is requested that the Board of Adjustment and Appeals recommend the City Council amend the $886.00 special assessment to $733.00 due to a clerical error.
