Board of Adjustment and Appeals - Regular Session
Meeting Date: 09/07/2017
Subject:    Case 17-22V, Special Assessment Objection, Jocelyn Hammonds, 10485 Crocus St NW, 21-31-24-24-0015
From: Trevor White

INTRODUCTION
Unpaid penalties in the amount of $300.00 associated with code enforcement activity against the subject property are proposed to be assessed to the property. The property owner has filed an objection to the assessment.
BACKGROUND & CONSIDERATIONS
The following chronology relates to actions and procedures leading to the special assessment in this matter.

On 08/24/2016, an Administrative Citation #65784-26987 was issued with one count for an inoperable vehicle ($300.00 penalty) and one count for exterior storage ($300.00 penalty). The citation established a compliance date of 09/06/2016.

On 09/08/2016, the property was re-inspected and found to be in compliance with both counts of Administrative Citation #65784-26987. No penalties were charged.

On 10/05/2016, a Second Violation Administrative Citation #66308-27137 was issued with one count for an inoperable vehicle.  As a second violation within 180 days, the penalty doubled ($600.00 penalty). The citation established a compliance date of 10/15/2017. The citation was mailed to the owner of record and not returned as undeliverable.

On 10/18/2016, an appeal was received by mail from the property owner. The appeal was received after the original compliance date and was stricken by the Hearing Examiner.

On 11/18/2016, the property was re-inspected and found to be in compliance. Because this was a subsequent violation, one-half of the penalty was waived resulting in a $300.00 penalty.

Penalty charged: $300.00

In her written objection to this special assessment, the property owner addresses a recent citation that was issued on 7/26/2017 for vehicles with expired registration.  This citation is not subject to the current assessment role.  However, the property has been re-inspected with respect to this citation and found to be in compliance.  No penalty was charged.

Total penalties charged: $300.00
ACTION REQUESTED
In Case 17-22V, it is requested the Board of Adjustment and Appeals recommend the City Council affirm the $300.00 special assessment in its entirety.
