INTRODUCTION
An unpaid penalty in the amount of $300.00 associated with code enforcement activity against the subject property is proposed to be assessed to the property. The property owner has filed an objection to the assessment.
BACKGROUND & CONSIDERATIONS
The following chronology relates to actions and procedures leading to the special assessment in this matter.
On 06/05/2019, an Administrative Citation was issued for long grass and/or weeds exceeding eight inches in height, the maximum allowed by City Code ($300.00 penalty). The citation established a compliance date of 06/13/2019. The citation was posted to the property and a courtesy letter mailed to the owner of record (same address) and not returned as undeliverable.
On 06/13/2019, the property was re-inspected and was in compliance. The $300.00 penalty was not charged.
On 08/13/2019, an Administrative Citation was issued for long grass and/or weeds exceeding eight inches in height, the maximum allowed by City Code ($300.00 penalty). The citation established a compliance date of 8/21/2019. The citation was posted to the property and a courtesy letter mailed to the owner of record (same address) and not returned as undeliverable.
On 08/21/2019, the property was re-inspected and the grass had been cut. The $300.00 penalty was not charged. However, as a subsequent long grass citation in the same season one half of that penalty is waived, resulting in a $150.00 penalty.
Penalty charged: $150.00
ACTION REQUESTED
In Case 19-17V, it is requested the Board of Adjustment and Appeals recommend the City Council affirm the $150.00 special assessment in its entirety.
