Unpaid penalties in the amount of $3,293.50 associated with code enforcement activity against the subject property are proposed to be assessed to the property. The property owner has filed an objection to the assessment.
The following chronology relates to the actions and procedures leading to the special assessment in this matter.
On 05/10/2018, an Administrative Citation was issued with three counts, one for junk vehicles with expired registration, one for exterior storage and one for parking off pavement at the subject property. The citations carried a $300.00 penalty for each violation. When the property was re-inspected by City staff, compliance with City Code was noted and no penalty was charged.
On 10/02/2018, a Subsequent Violation Administrative Citation, #71000-33613 was issued with one count for a vehicle displaying expired registration tabs and one count for exterior storage.  As subsequent violations within 180 days, the penalties doubled: $600.00 penalty per violation. The citation established a compliance date of 10/09/2018. The citation was mailed to the owner of record (same address) and posted on the front door. City staff noted the property appeared vacant and the overhead garage door was not secure
On 10/03/2018, Staff had the overhead garage door secured by a City contractor. The secure charges of $98.50 and a $76.00 administrative fee was charged.
Total charged: $174.50
On 10/10/2018, the property was re-inspected. The vehicle was removed from the property and was in compliance with city code. Per City Code Section 2-1104 any subsequent citation for the same violation and found to be compliant by the compliance date, one-half of the citation penalty is waived, resulting in a $300.00 penalty. The exterior storage remained in violation and abatement for the exterior storage was scheduled with the City abatement contractor.
Total charged: $300.00
On 10/10/2018, the exterior storage was abated. The $600.00 penalty for exterior storage, abatement costs of $2,143.00 and a $76.00 Administrative fee was charged.
Total charged: $2,819.00
Total penalties charged: $3,293.50
In Case 19-09V, it is requested the Board of Adjustment and Appeals recommend the City Council affirm the $3,293.50 special assessment in its entirety.
