Discuss Proposed Amendments to Chapter 7-300 Drug Paraphernalia

Council is asked to discuss amendments to City Code Chapter 7-300 Drug Paraphernalia.
In July of 2019, Staff received an anonymous complaint indicating that several of our licensed tobacco businesses were selling what appeared to be drug paraphernalia, which included various pipes staff does not believe are designed to be used with tobacco products as is required by City Code. A letter was sent in July 2019 to all tobacco license holders outlining the City's Code and State law as it relates to the selling of drug paraphernalia, and received a mixed response. Of the 44 licensed tobacco holders, all but three (3) agreed to remove the types of pipes that staff consider to be drug paraphernalia. The three license holders have challenged our City Code's definition of drug paraphernalia.
After consultation with the City Attorney's office, and at their recommendation, Staff is proposing that Chapter 7-300 of the City's Code be amended to better define drug paraphernalia.
The attached Ordinance outlines the proposed additions to Chapter 7-300.
